Welcome to Littpanda.com (“Littpanda,” “we,” “us,” or “our”), a subsidiary of Visualize One, LLC. These Terms of Service (“ToS”) govern your use of Littpanda.com, including our website, mobile apps, and services on platforms like Roku, Xbox, PlayStation, and Chromecast (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these ToS. If you do not agree, do not use the Services.
1. Eligibility
- You must be at least 13 years old to use the Services, in compliance with the Children’s Online Privacy Protection Act (COPPA). Users under 18 must have parental consent.
- You must have a valid subscription to Crunchyroll, HIDIVE, or Bilibili to participate in watch parties, as we stream licensed content from these providers.
2. Account Registration
- You may need to create an account to access certain features (e.g., watch party rooms, activity feed). You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate information during registration and to update it as needed.
- We reserve the right to suspend or terminate accounts for fraudulent or unauthorized activity.
3. Services Description
Littpanda.com provides an anime watch party platform where users can:
- Join or create rooms to watch anime/donghua streams from Crunchyroll, HIDIVE, or Bilibili.
- Share webcam feeds (up to 4 per room) using AWS MediaLive.
- Chat in real-time and post in a geolocated activity feed with hashtags,@mentions, and emoji reactions (like, dislike, shocked, angry, laughing).
- View Billboard charts, a 3D spinning globe (or static image on Chromecast), and live graphs of user activity.
- Cast rooms to Chromecast devices using our Custom Receiver app (ID 810D9732).
4. User Conduct
- You agree not to:
- Use the Services to stream, share, or access pirated or unauthorized content.
- Engage in harassment, bullying, or abusive behavior in chats or activity feeds.
- Share webcam feeds or content that is illegal, obscene, or violates third-party rights.
- Attempt to bypass subscription requirements for Crunchyroll, HIDIVE, or Bilibili.
- Use automated tools (e.g., bots) to scrape data or disrupt the Services.
- You are responsible for content you post (e.g., activity feed posts, chat messages, webcam feeds). We may remove content that violates these ToS.
5. Intellectual Property
- Our Content: All content on Littpanda.com (e.g., 3D profiles, charts, UI) is owned by Visualize One, LLC or our licensors and is protected by copyright laws. You may not reproduce, distribute, or modify our content without permission.
- User Content: By posting content (e.g., activity feed posts, webcam feeds), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute it as part of the Services.
- Streaming Content: Anime/donghua streams are provided by Crunchyroll, HIDIVE, or Bilibili. You must comply with their terms of service, and we are not responsible for their content.
6. Third-Party Services
- The Services integrate with third-party platforms (e.g., Crunchyroll, HIDIVE, Bilibili, AWS MediaLive, Chromecast). Your use of these services is subject to their respective terms.
- We use ipapi.co for IP-based geolocation to track user locations (country, state, city) for logged-out users and geolocated posts. See our Privacy Policy for details.
7. Payments and Monetization
- Premium Features: We offer premium features (e.g., custom room themes, additional webcam slots) via WooCommerce. All payments are final unless otherwise stated.
- Ads: We display ads via AdSense. We are not responsible for third-party ad content.
- We reserve the right to modify pricing or introduce new fees with notice.
8. Termination
- You may stop using the Services at any time.
- We may suspend or terminate your access if you violate these ToS, fail to maintain a valid streaming subscription, or engage in illegal activity.
- Upon termination, your account data and user content may be deleted, except as required by law.
9. Disclaimers and Limitation of Liability
- As-Is Service: The Services are provided “as is” without warranties of any kind, including fitness for a particular purpose or uninterrupted access.
- Streaming and Webcams: We are not responsible for interruptions in streaming (e.g., Crunchyroll outages) or webcam feeds (e.g., AWS MediaLive downtime).
- User Content: We do not endorse user content (e.g., activity feed posts, chats) and are not liable for its accuracy or legality.
- Liability Cap: To the fullest extent permitted by law, Visualize One, LLC’s liability for any claim arising from the Services shall not exceed $100.
10. Indemnification
- You agree to indemnify and hold harmless Visualize One, LLC, its subsidiaries (including Littpanda.com), and affiliates from any claims, damages, or losses arising from your use of the Services or violation of these ToS.
11. Governing Law and Dispute Resolution
- These ToS are governed by the laws of the State of California, USA, without regard to conflict of law principles.
- Any disputes shall be resolved through binding arbitration in California, except for small claims court matters. You waive the right to participate in class action lawsuits.
12. Changes to These Terms
- We may update these ToS at any time. We will notify users of material changes via email or a website notice at least 30 days before the changes take effect.
- Continued use of the Services after changes constitutes acceptance of the new terms.
